The Williams Companies, Inc. WMB is reportedly facing a fresh regulatory hurdle for its long-delayed Northeast Supply Enhancement (NESE) natural gas pipeline project. The U.S. Third Circuit Court of Appeals reversed a key New Jersey water permit for the project, granting petitions filed by environmental groups and remanding the Water Quality Certification to the New Jersey Department of Environmental Protection (NJDEP). The ruling creates another challenge for a project that has already faced significant regulatory opposition.
Williams, however, remains committed to moving ahead. The company said it is working promptly with state regulatory officials to address the court’s findings and does not currently expect the decision to affect construction or its anticipated in-service timeline. Williams is targeting completion of NESE in the fourth quarter of 2027.
NESE Targets Rising Northeast Gas Demand
NESE is a roughly $1 billion project being developed by Williams’ Transco unit. The project would expand the existing Transco pipeline system and include an offshore pipeline segment in Raritan Bay between New Jersey and New York. Once completed, NESE is designed to transport around 0.4 billion cubic feet per day of natural gas from Pennsylvania through New Jersey and into New York.
The expansion is aimed at addressing rising energy demand across the Northeast. Williams expects the project to increase Transco’s capacity by 400,000 dekatherms per day, providing enough energy to serve the equivalent of about 2.3 million homes. This additional capacity could strengthen the natural gas supply to New York, New Jersey and Pennsylvania, particularly during periods of peak winter demand.
Environmental Opposition Remains a Key Risk
The latest court decision follows a lawsuit filed by environmental groups against NJDEP. The groups argued that the state had unjustifiably approved the certification after previously rejecting the project in 2019 for failing to demonstrate compliance with state water quality standards.
Opponents have also raised concerns about the project’s underwater segment, arguing that dredging the Raritan Bay floor could disturb sediment containing contaminants such as mercury and PCBs (polychlorinated biphenyls). These environmental concerns could continue to create regulatory uncertainty for Williams as it works to advance NESE.
Long-Term Benefits Could Support Williams
Despite the regulatory setback, NESE offers strategic benefits if Williams can keep the project on track. Greater pipeline capacity would improve energy security in the Northeast by providing additional natural gas during high-demand periods. The project could also support growing demand from population growth, industrial activity and seasonal consumption.
For Williams, successful completion would strengthen its Transco system and improve access to key Northeast markets. The project is also expected to support economic activity through construction and long-term operations.
Overall, the court ruling introduces another obstacle, but Williams’ continued commitment and the strong regional need for additional gas infrastructure remain positive factors. Investors will likely focus on how quickly the company and NJDEP can address the court’s concerns without materially delaying NESE’s targeted 2027 completion.
